Pet Boarding and Care Terms and Conditions

 

Overview:

        This website is operated by Ohayo Pet, throughout the site, the terms “we”, “us” and “our” refers to Ohayo Pet, “Owner” refers to the owner of the pet or agent for the pet owner.

        The below Terms and conditions apply to all users of the site and all services provided by Ohayo Pet.

1.      Eligibility and Pet Health:

        Pets must be at least 4 months old, fully vaccinated, and desexed for boarding.

        Pets’ microchip registration must be up to date with relevant authorities. This is to protect the pet in the unlikely event of escape from our premises during its stay.

        The Owner must provide proof of current vaccination.

        The Owner warrants that its pet is free of all diseases and illnesses.

        If the pet is on any medications that must be administered during their stay, and/or has a serious or long-term health condition, the Owner must provide an up-to-date copy of the pet’s medical history from their vet.

        Ohayo Pet reserves the right to refuse entry to any pet.

        Ohayo Pet reserves the right to refuse accommodation for seriously unwell pets, or the pets showing signs of illness or infectious disease upon check-in regardless of vaccination status or other high risk potential pets.

2.      Accommodation and Stay:

        Individual rooms/cages are provided for each pet.

        Multiple pets from the same family may share a room/cage by owner’s consent.

        Prior to arrival, owners are encouraged to administer flea and worm treatment 2 weeks prior to their arrival at Ohayo Pet. We can provide treatment with additional charges. Ohayo Pet will make reasonable attempts to contact the Owner if we find the pet requires further flea or worming treatment. If Ohayo Pet cannot establish contact with the Owner, we reserve the right to apply such treatment at an additional cost, which must be settled upon check-out. Any pet showing signs of flea infestation might be held in isolation by us until deemed fit to transfer back into our boarding facility.

        Standard boarding rates will apply for each night if the pet isn't picked up after the checkout date.

3.      Rates and Payment:

        Boarding rates are charged per calendar night.

        A deposit of $50 or 25% of the full amount, whichever is greater, is required when making a booking. Remaining balance for the entire booking duration is required before check-in.

        Deposit is non-refundable but can be held as credit for 6 months from cancellation date.

        Peak period refers to Victorian School Holidays, all Victorian public holidays and Christmas Holidays (20/12-10/01).

        Check-in and checkout are available during business hours, and after-hour service is subject to availability with an additional charge.

        Unclaimed pets 14 days after the checkout date may be considered abandoned and will be sent to animal shelter.

        No refunds or credits will be given for early pick-ups

4.      Medication and Nutrition:

        Medication will be administered to pets based on instructions provided by the owner. All medication that the pet requires during their stay must be supplied with clear and correct labelling. Ohayo Pet is not responsible for any liability in relation to the administration or lack of administration of the medication to the pet. 

        We will follow the owner's feeding instructions if they provide their own food.

        We will not be held responsible for the quality and safety of any food provided by the owner.

5.      General Clauses:

        In the event that the owner gets someone else to drop off the pet to us, the owner acknowledges that this person is considered authorized to be the nominated representative for their pet. All decisions and directions given by the representative are effectively an extension of the owner’s wishes, including signing of any agreements or forms. Ohayo Pet accepts no responsibility for communication errors between the owner and their representative.

        The owner agrees to pay all costs and charges for any special services requested or deemed necessary by Ohayo Pet during the stay including but not limited to vet fees, medical costs, travel fees and labour costs.

        The facility in their sole and absolute discretion may retain the service of a registered veterinary to attend to any pet requiring veterinary care. The veterinary fees and any additional charges incurred shall be at the expense of the Owner who hereby agrees to indemnify Ohayo Pet in respect of them.

        If the pet becomes seriously ill and the Owner cannot be contacted, the veterinarian’s decision in relation to treatment of the pet shall be final and conclusive. The Owner authorizes Ohayo Pet to proceed with all necessary treatments and investigations and will pay all veterinary costs upon check-out. The Owner also acknowledges that if the pet falls ill during its stay, it might be relocated to isolation or to the vet clinic or hospital until it is deemed medically fit to return to boarding.

        Under no circumstances will Ohayo Pet or its employees be held responsible for any injury, sickness, death, loss or damage of any kind whatsoever, whether caused by any negligent act or omission of Ohayo Pet, its employees, that may occur to any pet staying at the premises.

        The owner agrees to allow the pet to be photographed and/or filmed for promotional purposes. If the owner does not give consent to use any recorded footage of the pet, please notify us on check-in.

        The owner certifies the accuracy of all information provided to Ohayo Pet. 

        The facility is not responsible for collars, leads, containers, or other left articles.

        Misrepresentation may result in refusal or cancellation of the booking.

        Any remaining balance should be paid before or at the time of checking out from the facility.

        That if any time the payment for fourteen days accommodation is outstanding, and/or payment for veterinary services is not made for fourteen days, pet will be returned to the pets registered address or an animal shelter. This will only take place if the prior arrangements have not been made and the owner or owner’s emergency contact cannot be reached through multiple attempts.

6.      Transport:

        Ohayo Pet does not guarantee transportation of your pet(s). Pet transport is subject to availability.

        Quotations are valid for 24 hours after Ohayo Pet sends the quote.

        The owner must provide a secure carrying cage that will prevent the pet from escaping during transportation.

        Transport booking times are indicative only. Ohayo Pet does not guarantee pick-up/drop-off times of your pet(s).

        The pet will be handed over to whoever claims to be the owner or the agent of the owner at the nominated address provided, unless otherwise advised by the owner.

        Ohayo Pet Taxi service cancellations or changes require a minimum 24-hour notice, or a full charge will apply.

7.      Check-In and Check-Out:

       Check-ins and check-outs must occur between 9:00am – 17:00pm

       Any early check-in or late check-out is offered solely at the discretion of Ohayo Pet.

       Refunds will not be issued if the Owner check-in late or check-out early.

8.      Privacy Policy:

       Ohayo Pet is the owner and publisher of the content contained in this website and their application(s) if any. This privacy policy applies to Ohayo Pet. 

       We respect your privacy and are committed to handling your personal information in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth). 

       The kinds of personal information we collect and store may include:

o   Personal information you give us when you request a product or service from us. Such information may include the dates you intend to board your pet/s and details relating to your cat(s);

o   Personal information you give us when you make a booking. This may include your name, address, telephone numbers, email address, and credit card details;

o   Communications between you and us;

o   Transactional information about your use of our products and services (e.g. feedback on our services and products, completing surveys or submitting feedback).

o   Device information when you are using our website or applications; o Usernames and passwords if using our customer portal.

       Our employees are responsible for handling your personal information. Personal information that we have on file is protected securely. Access to and use of your personal information is limited to those who specifically need it to conduct their responsibilities. We take reasonable steps to destroy your personal information where it is no longer needed and to protect your personal information from unauthorized access, misuse, disclosure and loss.

       Ohayo Pet cannot guarantee the security of your personal information as data protection and security measures are never completely secure. 

       You shall take reasonable care to protect your personal information and you should notify us immediately after you become aware of any security breaches.

       You acknowledge that we may disclose your personal information, including but not limited to any entity which we are required under law to disclose such information; to other parties i.e. veterinarian in the event of a medical emergency; and to our professional advisors. 

9.      Governing Law and Jurisdiction:

The laws of Victoria govern this agreement and the parties submit to the exclusive jurisdiction of the courts of Victoria.

10.  Severability:

If anything in this agreement is unenforceable, illegal or void then it is severed and the rest of this agreement remains in force.

11.  Acknowledgement

The owner acknowledges that by signing this agreement they agree to the above terms and conditions.

We reserve the right to amend, modify, or update these terms and conditions at any time without prior notice. It is your responsibility to review our website’s (if any) terms and conditions regularly for updates. Your continued use of the service after any alterations or updates indicates acceptance of the updated terms.
